Terms of Use

These terms apply to your use of the Lautly language learning app ("Lautly"). By creating an account or using the app you agree to them.

1. Provider

Lautly is provided by Sharmin Afroz, Bernsdorfer Str. 115, 09126 Chemnitz, Germany ("we", "us"). Contact: sharmin.ahsan@hotmail.com.

2. The service

Lautly helps you learn German with lessons, practice, pronunciation feedback, and cards. Some features use artificial intelligence (speech scoring, text recognition, and generated cards and explanations).

• Learning, not certification. Lautly prepares you for exams such as those of the Goethe-Institut or telc, but it is not affiliated with them. Scores, levels and plans in the app describe your practice; they are not a prediction or guarantee of any exam result.
• AI-generated content can be wrong. Generated cards, explanations and scores are checked where we can, but may contain errors. Please use your judgement.
• We keep improving Lautly and may change, add or remove features. We will not remove a feature you have paid for during a paid period without offering a fair alternative or refund.

3. Your account

You need an account to use Lautly. Keep your sign-in secure; you are responsible for activity on your account. You can delete your account at any time in the app (You › Account › Delete account).

You must be at least 16 years old, or have the agreement of a parent or guardian.

4. Free and paid features

Lautly offers a free plan with limits (for example, a weekly number of pronunciation checks) and paid plans, offered as monthly or yearly subscriptions and as one-time purchases. The prices and what each plan includes are shown in the app before you buy.

Purchases are made through the Apple App Store and are subject to Apple's Media Services Terms:

• Payment is charged to your Apple ID when you confirm the purchase.
• Subscriptions renew automatically for the same period and price unless you turn off auto-renewal at least 24 hours before the end of the current period, in your Apple ID account settings.
• You can manage and cancel subscriptions in your Apple ID account settings. Cancelling stops the next renewal; the current period continues until it ends.
• Refunds are handled by Apple under its policies. Your statutory rights as a consumer, including any right of withdrawal, are not affected.
• "Restore purchases" in the app restores what you have bought on a new device.

5. Acceptable use

Do not misuse Lautly, including by trying to access it other than through the app, interfering with its operation or security, circumventing usage limits, submitting unlawful content, or using photos or text you are not entitled to use.

6. Content and licence

The lessons, audio, images and software in Lautly belong to us or our licensors. We grant you a personal, non-transferable, non-exclusive licence to use Lautly for your own learning. Cards you create belong to you; you give us the rights needed to process them to provide the service.

7. Liability

We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and where mandatory law (such as product liability law) requires it. For slight negligence, we are liable only for breach of an essential contractual obligation, limited to the damage typical and foreseeable for this kind of contract. Otherwise our liability is excluded.

We aim for Lautly to be available at all times but cannot guarantee uninterrupted availability, particularly of features that depend on the internet or third-party services.

8. Ending the contract

You can stop using Lautly and delete your account at any time. We may suspend or end your access if you seriously breach these terms, after warning you where reasonable. Paid periods already purchased are handled according to section 4 and applicable law.

9. Changes to these terms

We may update these terms for valid reasons (for example, new features or changes in law). We will tell you about significant changes in the app in advance. If you do not agree, you can end the contract before the changes take effect.

10. Law and disputes

These terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country where you live.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.
